Market Stall Agreement

1. Booking, Fees, and Payment

• Application & Acceptance: Submission of an application does not guarantee a space. The Organizer reserves the right to accept or reject applications based on product mix and space availability.
• Fees: All stall fees must be paid in full by the due date specified on the invoice. Failure to pay on time, without correspondence, may result in the immediate forfeiture of the allocated stall space.
• Cancellations & Refunds:
  • Cancellations made by the Stallholder more than 28 days before the market date will receive a Full refund.
  • Cancellations made less than 14 days before the market date are non-refundable.

2. Market Operations & Hours

• Operating Hours: The market will operate from 8 am to 4 pm.
• Setup: Stallholders may access the venue for setup starting at 8 am. Setup must be fully completed 15 minutes before the market opens to the public.
• Pack-Down: Stallholders must not begin packing down their stall until at least 30 minutes before official closing time. If extra time would be required for pack down, we have helpers to assist you, just let us know in advance. All equipment and stock must be cleared from the venue by 5 pm.

3. Stall Allocation & Requirements

• Allocation: The Organizer retains absolute discretion over stall placement and layout. However, requests will be considered. Stallholders may not swap, sublet, or share their allocated space without prior written consent from the Organizer.
• Equipment: Stallholders must provide their own tables, chairs, tablecloths, and display structures. All equipment must be clean, safe, and fit for purpose. There can be no marks left on the walls if any marketing material is used.

4. Products and Merchandising

• Approved Items Only: Stallholders may only sell the items explicitly listed and approved in their original application.
• Presentation: Stalls must be presented in a professional, neat, and visually appealing manner.
• Prohibited Items: The sale of counterfeit goods, illegal substances, sharp weapons, or hazardous materials is strictly prohibited.

5. Rubbish and Waste Management

• Cleanliness: Stallholders must maintain a clean and safe environment within and around their stall throughout the day.
• Waste Removal: Stallholders are responsible for removing all of their own rubbish, packaging, and unsold stock at the end of the market. The venue’s public bins must not be used for commercial waste disposal. However, food rubbish or smaller scale rubbish can be put in the venue bins.

6. Compliance, Licensing, and Safety

• Legal Compliance: Stallholders must comply with all relevant local council regulations, consumer laws, and health and safety standards.
• Electrical Safety: All electrical equipment brought to the market must be tested and tagged by a certified professional prior to use.

7. Insurance and Indemnity

• Public Liability Insurance: The Stallholder must hold a current Public Liability Insurance policy with a minimum coverage of $10,000,000. A copy of the Certificate of Currency must be emailed to the Organizer at least a week before the event.
• Indemnity: The Stallholder agrees to indemnify and hold harmless the Organizer against all claims, damages, liabilities, losses, or expenses arising from the Stallholder’s participation in the market, including any injury to persons or damage to property.

8. Code of Conduct and Termination

• Behavior: Stallholders must conduct themselves in a polite, cooperative, and professional manner. Aggressive, abusive, or disruptive behavior toward customers, staff, or fellow stallholders will not be tolerated.
• Breach of Agreement: The Organizer reserves the right to terminate this agreement immediately and evict any Stallholder who breaches these terms, without any refund of fees.
